Terms of Service

These Terms of Service govern your use of the QR Collect platform — including time tracking, site check-in, visitor registration, asset management, and automated workflow features. By accessing or using QR Collect, you agree to these terms. If you're using the platform on behalf of a business, you're confirming you have the authority to bind that business to them. If you don't agree with anything here, don't use the service. This document runs alongside our Privacy Policy, which covers how we handle your data.

1. Acceptance of Terms

By creating an account, scanning a QR code, signing in on site, or otherwise using QR Collect, you agree to these Terms of Service and any other policies we reference here. If you're setting up the platform for your business, you're responsible for making sure your workers, contractors, and visitors are aware that their data is being processed through QR Collect. These terms apply to all users — account administrators, workers clocking in via the app, and visitors scanning a code at a gate.

2. Description of Service

QR Collect is a workforce and asset management platform that replaces manual time capture with QR code scanning. The service includes:

  • Time Tracking: Workers scan in at the start of a shift and scan out when they're done. Entries are accurate to the minute and exportable to payroll.
  • Site Check-In & Visitor Registration: Visitors and contractors sign in by scanning a QR code, complete a questionnaire, and the right person gets notified.
  • Asset Management: Track asset conditions, inspections, and maintenance schedules through QR scans.
  • Automated Workflows: Logic-based automation — block access until an induction is complete, send follow-up alerts, flag safety issues on scan.
  • Reporting & Export: Timesheets, attendance records, and visitor logs generated and exported for payroll and compliance purposes.

We may add, change, or remove features over time. We'll give you reasonable notice of material changes that affect how you use the platform.

3. User Accounts and Responsibilities

To use QR Collect as an administrator, you'll need to create an account. You're responsible for:

  • Account Security: Keeping your login credentials secure and not sharing them with anyone who shouldn't have access.
  • Accurate Information: Providing correct business and contact details when setting up your account.
  • User Management: Managing who has access to your organisation's QR Collect account and removing access for people who no longer need it.
  • Compliance: Making sure your use of QR Collect complies with your obligations under Australian workplace, payroll, and privacy laws — including your responsibilities as an employer handling worker and visitor data.

Workers and visitors don't need their own administrator account to scan a code, but they do interact with the platform. If you're an administrator, you're responsible for making sure your people understand what happens when they scan.

4. Acceptable Use

You agree not to:

  • Use QR Collect for any unlawful purpose or in a way that breaches Australian law.
  • Attempt to access systems, data, or accounts you're not authorised to reach.
  • Reverse engineer, decompile, or try to extract the underlying code of the platform.
  • Upload or transmit malware, viruses, or anything designed to disrupt the service.
  • Use the platform to harass, discriminate against, or unfairly monitor workers in breach of workplace laws.
  • Resell or sublicense access to QR Collect without our written permission.

We reserve the right to suspend or terminate access if we believe these terms have been breached.

5. Subscriptions and Payment

QR Collect operates on a subscription basis. The specifics of your plan — pricing, billing cycle, and included features — are set out in your order confirmation or the plan details agreed when you signed up.

  • Billing: Subscription fees are billed in advance on a recurring basis. Your plan continues until you cancel it or we terminate it under these terms.
  • Payment: You're responsible for paying all fees on time. If a payment fails, we may suspend access until it's resolved.
  • Price Changes: We may adjust our fees from time to time. We'll give you at least 30 days' notice before any price increase takes effect.
  • Cancellation: You can cancel your subscription at any time. Cancellation takes effect at the end of your current billing period — no refunds for partial periods unless required by law.

6. Intellectual Property

QR Collect — including the platform, its design, code, QR code generation system, branding, and content — is owned by QR Collect and protected by Australian intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to use the platform for your business operations for as long as your subscription is active.

You retain ownership of all data you put into QR Collect — timesheets, visitor records, asset logs, and configuration settings. We don't claim rights over your data. You're responsible for making sure you have the rights to any information you upload, including worker and visitor details.

7. Worker and Visitor Data

As an administrator, you control the data captured through QR Collect — including worker timesheets, visitor sign-in records, and asset information. You're responsible for:

  • Lawful Collection: Making sure you have a lawful basis to collect worker and visitor data, including any consent or notification required under Australian privacy law.
  • Signage: Displaying appropriate notices at scan points so workers and visitors know their data is being captured by QR Collect.
  • Data Accuracy: Keeping the information in your account up to date and accurate.
  • Access Management: Giving workers and visitors a way to ask about the data you hold about them, as required by law.

8. Third-Party Services and Links

QR Collect may integrate with or link to third-party services — payroll systems, cloud hosting providers, analytics tools, and others. We're not responsible for the practices, availability, or content of those third-party services. Your use of any third-party service is governed by their own terms and policies.

We may change or replace third-party providers over time. If a change materially affects your data or integrations, we'll give you reasonable notice.

9. Privacy

Your use of QR Collect is also governed by our Privacy Policy, which explains how we collect, use, store, and protect personal information. You should review it alongside these terms. You can read the full Privacy Policy here.

10. Limitation of Liability

To the maximum extent permitted by Australian law:

  • QR Collect is provided on an "as is" and "as available" basis. We don't guarantee the platform will be uninterrupted, error-free, or that your data will never be lost.
  • We're not liable for indirect, incidental, or consequential losses — including lost profits, lost business, or payroll errors arising from data entered incorrectly.
  • Our total liability for any claim arising from your use of QR Collect is limited to the fees you've paid us in the 12 months before the claim.

Nothing in these terms excludes or limits liability that can't be excluded under Australian law — including liability for fraud or for death or personal injury caused by negligence.

11. Indemnity

You agree to indemnify QR Collect against any claims, losses, damages, or costs arising from:

  • Your breach of these terms.
  • Your misuse of the platform.
  • Data you upload that breaches someone else's rights or Australian law.
  • Claims by your workers, contractors, or visitors regarding how their data was collected or used through QR Collect.

12. Term and Termination

These terms start when you first use QR Collect and continue until your account is closed. Either party can end this agreement:

  • By You: You can cancel your subscription at any time, effective at the end of your billing period.
  • By Us: We can suspend or terminate your access if you breach these terms, if your account is inactive for an extended period, or if we discontinue the service.
  • Effect of Termination: When your account closes, you'll lose access to the platform. We'll give you a reasonable window to export your data before it's permanently deleted, unless legal obligations require us to keep it longer.

13. Changes to These Terms

We may update these Terms of Service from time to time. If we make material changes, we'll notify you — by email, in-app notice, or a prominent notice on this page — before the changes take effect. The date of the most recent revision will be noted on this page. Continued use of QR Collect after changes take effect means you accept the updated terms.

14. Governing Law

These terms are governed by the laws of New South Wales, Australia. Any dispute arising from or relating to these terms or your use of QR Collect will be resolved in the courts of New South Wales. If any part of these terms is found to be unenforceable, the rest remains in force.
